ZYN User Generated Content Program

TERMS & CONDITIONS:

These Terms & Conditions (“Terms”) constitute a binding agreement between you (“You” or “Participant”) and Philip Morris (Pakistan) Limited (“PMPKL”). By participating in the ZYN Apple Mint User Generated Content Program (“Program”) and submitting content, you confirm that you have read, understood, and agreed to be bound by these Terms and any related Program guidelines issued by PMPKL from time to time.

1. The Program:

The Program offers eligible adult ZYN consumers the opportunity to submit original photographs and/or videos (“Content”) featuring themselves and ZYN Apple Mint (of any nicotine strength). From all eligible submissions received during the Program Period, PMPKL will shortlist five (05) entries based on evaluation criteria mentioned below and compliance with these Terms. The shortlisted entries will be posted on PMPKL’s official social media platforms, i.e. ZYN Instagram and ZYN Facebook, and opened for voting by adult followers of these platforms. The entry receiving the highest number of valid votes will be declared the winner and will receive a Samsung Watch 6 Classic. The runner-up will receive Samsung Buds 2 Pro (collectively referred to as the “Prize”). Remaining shortlisted entries will not receive any prizes. PMPKL reserves the right to verify the authenticity of votes and to disqualify any entry where fraudulent, automated, manipulated, or suspicious voting activity is detected.

2. Eligibility: The Program is ONLY open to Adult ZYN Consumer who:

(i) Reside in Lahore, Islamabad, and Peshawar, Pakistan;

(ii) Follow both ZYN Pakistan’s Instagram and Facebook account; AND

(iii) Maintain a public Instagram and/or Facebook account at the time of participation.

2.2 Employees of PMPKL and/or the advertising agencies involved in this Program, and their immediate family members are not eligible to participate.

2.3 PMPKL reserves the right to request proof of age, identity, and residency at any stage of the Program either directly or through its authorized third party agency.

3. Program Period: The Program shall commence on 13th March 2026. The entry submission period is between 13th March till 23rd March 2026. PMPKL reserves the right, at its sole discretion, to modify the Program Period with due notification as PMPKL deems appropriate.

4. How to Participate: To enter the Program, eligible participants must:

(i) Submit original Content featuring ZYN Apple Mint can.

(ii) Submit the Content exclusively via private direct message (“DM”) to ZYN Pakistan’s Instagram and/or Facebook account.

(iii) Ensure the content is genuine and created solely by the Participant. AI-generated content is strictly prohibited.

(iv) Ensure the Content does not contain any third-party copyrighted, trademarked, or protected material without proper authorization.

(v) Ensure the Content does not appeal to minors or directly or indirectly encourage, promote, or induce nicotine use, especially among non-users or underage individuals.

(vi) Obtain prior Consent from any identifiable individuals appearing in the content.

(vii) Ensure the Content does not contain unlawful, threatening, abusive, defamatory, vulgar, obscene, or otherwise inappropriate material.

(viii) Incomplete or non-compliant entries may be disqualified at PMPKL’s sole discretion.

(ix) Spam, link baiting or files containing viruses that could damage the operation of other people’s computers or mobile devices

5. Selection and Qualification of the 5 Shortlisted contestants: All submissions will be reviewed by PMPKL and/or its authorized third-party agencies. Five (5) Participants shall be shortlisted at the sole discretion of PMPKL in accordance with the below criteria, and applicable PMPKL internal policy:

(i) Alignment with the ZYN brand’s identity, values, and visual aesthetics.

(ii) Compliance with these Terms.

(iii) Creativity, originality, and uniqueness of the concept.

(iv) Signing of PMPKL consent forms (incase the selected participant refuse or fails to sign the required consent, PMPKL reserves the right to disqualify the winner and chose the next eligible participant).

6. Prizes: Out of the five shortlisted contestants, ONLY the winner and runner up will get the following prizes. No other prizes will be offered to any of the remaining shortlisted contestants:

(i) Winner will receive a Samsung Watch 6 Classic

(ii) Runner Up receive Samsung Buds 2 Pro.

6.1 The Prizes are non-transferable, non-exchangeable, and non-redeemable for cash or any other benefit.

6.2 The Prizes shall be on an 'as-is' condition. The actual specification of the Prizes may differ from the visuals appearing on the Website and marketing material. The color choice of the Prizes is based on PMPKL’s discretion and availability of the same.

6.3 PMPKL reserves the right to, at any time and in its sole and absolute discretion, replace and/or substitute the Prize with an alternative item of any value without prior notice and without any liability.

6.4 PMPKL makes no warranty or representation (whether express or implied) on the quality, merchantability or suitability for use of the Prizes.

7. Notification: The selected five participants will be notified via Direct Message through social media, email and/or call by PMPKL or it’s authorized third party representative. All five will undergo mandatory age verification through ID card validation by our authorized third party agency. If any of the chosen participants fails to submit the same or does not meet the eligibility requirements, he/she will be disqualified, and the next eligible participant shall be shortlisted.

8. Consent and General Terms: By participating in the Program you confirm and agree to:

(i) Grant PMPKL and its affiliates, a royalty free, perpetual right to the Content including license to use copy, market, promote, and/or advertising of PMI’s non-combustible brands, as well as thereto related products, services and promotional materials, at PMKL’s sole discretion and without any liability or warranties (express or implied) with respect to our use of it, from the date on which You submit the same to PMPKL.

(ii) You grant PMPKL and its affiliates the rights to reproduce, modify, translate, display and prepare derivative works, display, distribute, broadcast, and otherwise use the Content, in whole or in part in any way PMPKL (or any of its affiliates) desires, for the above purposes, in any anticipated print or digital media platforms for publication and in any geographies.

(iii) You allow PMPKL and its affiliates to use the name, nickname, likeness, pseudonym, rights of publicity, voice, live or recorded performance, autograph, photographs and biographical information of You and any other people included in the Content in accordance with our privacy notice available at https://www.pmiprivacy.com/en/business-partner, and that You have notified any other people included in the Content of these terms.

(iv) In case the Content infringes any proprietary rights of any third party or defame or invade the privacy or publicity rights of any person, You will indemnify, defend and hold PMPKL and its affiliates harmless from and against any and all claims, demands, damages, liabilities, losses, costs and expenses arising from or related to this breach.

(v) You agree that Your consent is voluntary and You are free to enter into it with PMPKL.

(vi) You agree that PMPKL either directly or through its authorized third party agency, reserves the right to conduct checks and verifications of the participants and winners for the purposes of complying with PMPKL policies and procedures and applicable laws and select alternative participants/winners if PMPKL reasonably there may be a breach of PMPKL policies, these Terms or any applicable laws.

(vii) You shall not promote or advertise PMPKL’s products and/or brands nor publish any content related to this Program in your independent or professional use of social and other digital media without obtaining PMPKL consent.

If You believe your copyright or intellectual property protected material has been used without authorization or if your privacy or personality rights have been infringed.

9. Data Protection: PMPKL shall collect and process the Participant’s personal data (including photographs, recordings, and contact details) directly or through its authorized third party agency solely for the purposes of this Agreement and for shortlisting, voting, verification, validation, administration, and prize fulfillment, where applicable, and in accordance with applicable data protection laws. You confirm that you have read and understood the Company’s Privacy Notice and agree to its terms. You further consent and argee to PMPKL sharing your personal data with its affiliates, third party authorized agencies, service providers, and other third parties engaged for the administration of the Program. Such authorized third parties will contact you directly and information including your CNIC/passport or any other additional documentation for validation and to process the same strictly for Program-related purposes and in accordance with applicable data protection laws.

10. No Liability:

Participation in the Program is at will and by participating in the Program, participants release PMPKL and its affiliates, parents or subsidiaries and their respective directors, officers, agents and employees (“Released Parties”) from any and all liability for any loss, harm, damages, cost or expense. For the avoidance of doubt, any cancellation, termination or suspension by PMPKL of this Program shall not entitle participant to any claim or compensation against PMPKL for any and all losses or damage suffered or incurred.

Participants further agree to indemnify, defend and hold the Released Parties harmless from and against any and all third-party claims, demands, liabilities, costs or expenses, including attorney’s fees and costs, arising from, or related to any breach by Participants of any of these Terms or any violation by Participants of applicable law.

11. GENERAL:

(i) PMPKL reserves the right to change, amend, modify or suspend the Program, in whole or in part, at any time with or without notice.

(ii) PMPKL reserves the right at its sole discretion to disqualify participants and remove the submissions which PMPKL considers inappropriate.

(iv) In the event of any inconsistency between these terms and conditions and any advertising, promotional, publicity and other materials relating to or in connection with this Program, these Terms shall prevail.

(v) The decisions of PMPKL on all matters relating to or in connection with this Program, including in relation to any dispute in connection with this Program, are final, conclusive and binding. PMPKL shall not be obliged to give any reason or enter into any correspondence with any person on any matter concerning this Program.

12. Jurisdiction and Governing Law:

These Terms are governed and shall be construed in accordance with the Laws of Pakistan (“Jurisdiction”). You irrevocably consent to the exclusive jurisdiction of the courts located in Karachi, in case of any action to enforce these Terms.
