ZYN User Generated Content Program
TERMS & CONDITIONS:
These terms and conditions (“Terms”) are between you and Philip Morris Pakistan Limited (“PMPKL”). To participate in the ZYN User Generated Content Program, please carefully review these Terms and then click the "I Agree" button to indicate your acceptance to the Terms. This action will confirm your understanding and agreement to the Terms and guidelines of the Program, allowing you to proceed with participation.
1. The Program: The User Generated Content Program offers ZYN adult customers the opportunity to submit original photographs and/or videos featuring themselves using ZYN, nicotine pouches, during various activities or moments - such as traveling, watching a movie, or working (“ZYN Moments”). From these submissions, three winners will be selected by PMPKL to shoot for ZYN branded content at a three-day PMPKL sponsored trip to Baku, Azerbaijan, where they will be offered to bring one accompanying adult (either a friend or a family member) who must be a ZYN adult consumer (refer to para 6 below) (“Prize”). The branded content developed with the winners will be used by PMPKL for commercial purposes on various media platforms(“Program”) (for further information please see Section 6 below relating to Prize details and terms).
2. Eligibility: Participation in the Program is only open for adult consumers of ZYN nicotine pouches, residing in Karachi, Pakistan, who:
(i) follow the ZYN Pakistan’s Instagram and Facebook Account; and
(ii) have a public Facebook or Instagram account.
Employees of PMPKL, its affiliates, distributors and any advertising agencies directly involved in this Program, are not eligible to participate.
3. Program Period: The Program shall commence on 3rd Dec 2025. PMPKL reserves the right, at its sole discretion, to modify the Program Period with due notification as PMPKL deems appropriate.
4. How to participate: To enter the Program, eligible Participants shall take a picture and/or video of themselves with their ZYN can, capturing their ZYN moment and submit the same to PMPKL only via private direct message/inbox to ZYN Pakistan official Instagram and/or Facebook Page. It is to be noted that PMPKL will not accept any submissions that are shared otherwise then through direct message to the abovementioned PMPKL social media accounts.
5. Selection and qualification of winners:
(a) The selection of the winners for the Program will be based on the following criteria:
(i) The submission should align with the ZYN brand and it’s aesthetic. Submissions must not contain any unlawful, threatening, abusive, libelous, defamatory, vulgar, obscene content nor any material that may be considered to appeal to underage individuals, or encourages the use of nicotine to non-nicotine users.
(ii) The content should clearly feature ZYN nicotine pouch can and the participant. Extra points will be given to more creative and unique ideas.
(iii) The content must be genuine and original work created solely by the participant not AI generated.
(iv) Submissions should not contain any third-party copyrighted or trademarked material, and participants must obtain permission from any identifiable individuals featured in their photos before submission to PMPKL along with necessary permission(s) obtained.
(b) All submissions will be reviewed by PMPKL and it’s authorized third party agency and three final winners will be selected by PMPKL at its discretion based on the above criteria .
6. Prize:
The Prize is subject to the winner agreeing to participate in ZYN’s Branded content shoot at the assigned locations and provide PMPKL and it’s affiliates, a royalty free, perpetual right to use and copy, including for commercial purposes, the content, including for marketing, promoting and/or advertising of ZYN subject to the terms of the Agreement to be entered by and between the Winners and PMPKL. Incase, the winner does not agree to participate in the ZYN shoot or execute the Agreement to be provided by PMPKL, he/she will be ineligible for the Prize, his/her Prize will be deemed forfeited and PMPKL will accordingly select an alternative winner.
The Prize trip includes a round-trip economy airfare, standard hotel accommodation chosen by PMPKL including meals for the winner. Each winner has an option to bring one adult family member or friend who must be an adult ZYN consumer (“Guest”). Only the Guest’s travel fare shall be decided and paid for by PMPKL (subject to the condition that the guest travel originates from the same location as the winner) and standard meals available at the hotel shall be paid for by PMPKL included in the hotel booking and described in PMPKL itinerary. No separate hotel accommodation or other transport facility shall be provided to the Guest who may share hotel room with the winner (“Guest”). The winner and the Guest are solely responsible for all ancillary and personal costs not covered in the Prize. Full details including the trip’s itinerary and PMPKL safety travel safety guidelines shall be shared in a Travel Form to the winners by PMPKL at the time of selection of the winners. In case they do not agree to the same, he/she will be ineligible to obtain the Prize, and his/her Prize will be deemed forfeited and PMPKL will accordingly select an alternative winner.
If the winner chooses a friend, as the Guest, they must be the same gender. This requirement is essential due to reasons, such as room accommodation arrangements. If the winner brings a family member, they must provide documentation to prove the relationship. Common examples of such proof include, NADRA family registration certificate.
No travel allowance, money or commission shall be provided by PMPKL to the winner or the Guest.
This Prize is non-transferable, non-exchangeable, and non-redeemable for cash or any other benefit. If the selected winner or their guest is unable to travel due to any reason, no reimbursement, cash alternative, or substitute compensation will be provided. PMPKL reserves the right to determine whether the Prize will be offered to the next eligible winner in this case.
The travel will be scheduled last week of October and exact dates will be fixed by PMPKL at its discretion. PMPKL will not be liable for any delays, cancellation or unforeseen events beyond its control. The winner and the guest must comply with all travel rules, safety and policy requirements provided by PMPKL.
PMPKL expressly disclaims any responsibility for the personal conduct, activities, or decisions of the winners or their accompanying Guests during the trip.
PMPKL will not be held responsible or liable for any physical injury, monetary loss, accidents, or damages of any kind to the winner or Guest during the trip.
PMPKL reserves the right disqualify and not shoot with the winner if their or their guest’s behavior is illegal, tortious, against these T&Cs. PMPKL will not be held responsible or liable for costs incurred due to such behavior.
7. Notification: Winners will be notified via Direct Message, email and/or call by PMPKL’s authorized third party representative by [20 December 2025]. The winner will undergo age verification where they will be required to provide their valid NADRA CNIC Card. If any winner fails to submit the same or does not meet the eligibility requirements, he/she will be disqualified, and his/her Prize will be deemed forfeited.
8. Consent and General Terms: By participating in the Program you confirm:
(i) You grant PMPKL the right to use, disseminate, repost the submission shared as an entry, which may be posted on any media as decided by PMPKL including ZYN Official channels including but not limited to ZYN.com, ZYN Pakistan Facebook page, and ZYN Pakistan Instagram page for commercial purposes including any marketing, promoting and/or advertising etc of PMPKL’s Zyn product at PMPKL’s sole discretion and without any liability or warranties (express or implied).
(ii) You agree that PMPKL either directly or through its authorized third party agency, reserves the right to conduct checks and verifications of any winner for purposes of complying with PMPKL policies and procedures and applicable laws and select alternative winners if PMPKL reasonably believes that the award of the Prize to the winner would be in breach of PMPKL policies, these terms and conditions or any applicable laws.
(iii) You grant PMPKL and its affiliates the rights to reproduce, modify, translate, display and prepare derivative works, display, distribute, broadcast, and otherwise use the submission, in whole or in part in any way PMPKL (or any of its affiliates) desires, for the above purposes in any geographies.
(iv) You agree and consent that the information collected through the Program will be subject to and used in accordance with the Privacy Policy accessible at the Website or at https://us.ZYN.com/privacy-policy and give consent to PMPKL to share your information with authorized third-parties for the sole purpose of fulfilling your Prize and the Program modalities.
(v) You will not post any pictures, information, statement or comments relating to the Program on their social media accounts especially any content that may be perceived to be against the Program and/or PMPKL or may compromise the same. You agree that any such adverse posts or activity may be illegal and shall entitle PMPKL to terminate your participation in the Program along with restraining PMPKL to exercise any other legal remedy available.
(vi) You grant PMPKL and its affiliates to use the name, nickname, likeness, pseudonym, rights of publicity, voice, live or recorded performance, autograph, photographs and biographical information of you and any other people included in the submission in accordance with our business partner privacy notice available at https://www.pmiprivacy.com/en/business-partner, and that You have notified any other people included in the submission of these terms.
(vii) In case the submission infringes any proprietary rights of any third party or defame or invade the privacy or publicity rights of any person, you will indemnify, defend and hold PMPKL and its affiliates harmless from and against any and all claims, demands, damages, liabilities, losses, costs and expenses arising from or related to this breach.
9. No Liability:
Participation in the Program is at will and by participating in the Program, participants release PMPKL and its affiliates, parents or subsidiaries and affiliate companies, their respective directors, officers, agents and employees (“Released Parties”) from any and all liability for any loss, harm, damages, cost or expense, including, without limitation, property damages, losses, or loss or corruption of data or information, personal injury and/or death, arising out of or in any way connected to the Program whether in contract, tort (including negligence) or otherwise. For the avoidance of doubt, any cancellation, termination or suspension by PMPKL of this Program shall not entitle participant to any claim or compensation against PMPKL for any and all losses or damage suffered or incurred as a direct or indirect result of the act of cancellation, termination or suspension.
Participants further agree to indemnify, defend and hold the Released Parties harmless from and against any and all third-party claims, demands, liabilities, costs or expenses, including attorney’s fees and costs, arising from, or related to any breach by Participants of any of these Terms and Conditions or any violation by Participants of applicable law. Further, the Released Parties shall not be liable and disclaims all representations and warranties, express, implied or statutory including warranties of merchantability, fitness for particular purpose or use and non-infringement of third-party intellectual property rights.
10. GENERAL:
(i) PMPKL reserves the right to change, amend, modify or suspend the Program, in whole or in part, at any time with or without notice.
(ii) All decisions of PMPKL in all matters relating to the interpretation and implementation of this terms and conditions, including the mechanics are final, and no objections and/or appeals thereon will be entertained.
(iii) PMPKL reserves the right at its sole discretion to disqualify participants and remove the submissions described below and other content which PMPKL considers inappropriate:
(a) Posting any hateful or discriminatory comments regarding race, ethnicity, religion, gender, disability, sexual orientation or political beliefs.
(b) Links or comments containing sexually explicit, violent or unlawful material
(c) Violations of copyright or intellectual property rights
(d) Spam, link baiting or files containing viruses that could damage the operation of other people’s computers or mobile devices
(e) Attacks on specific groups or any comments meant to harass, threaten or abuse an individual
(f) Commercial solicitations or the promotion of a competitor
(g) Content featuring minors or particularly appealing to minors.
Encouraging use of nicotine amongst non-nicotine users.
(h) Customers using multiple emails / mobile numbers to participate in the Program
(i) If there is any evidence of fraud or irregularities in his/her participation in the Program or
(j) If they are found to tampers or attempts to tamper with the operation of the Program or the Sites, violates the Terms and Conditions;
(k) or act in any adverse manner or with intent to malign or threaten PMPKL.
(iv) In the event of any inconsistency between these terms and conditions and any advertising, promotional, publicity and other materials relating to or in connection with this Program, these terms and conditions shall prevail.
(v) The decisions of PMPKL on all matters relating to or in connection with this Program, including in relation to any dispute in connection with this Program, are final, conclusive and binding. PMPKL shall not be obliged to give any reason or enter into any correspondence with any person on any matter concerning this Program.
11. Jurisdiction and Governing Law:
These Terms are governed and shall be construed in accordance with the Laws of Pakistan (“Jurisdiction”). You irrevocably consent to the exclusive jurisdiction of the courts located in Karachi, in case of any action to enforce these Terms.
WARNING: This product is harmful and contains nicotine which is a highly addictive substance. This product is not risk free and contains nicotine, which is addictive. Only for us by adults who would otherwise continue to smoke or use other nicotine products.
