TERMS AND CONDITIONS: IQOS.com 3.3 Flash Deal

I. GENERAL

1. The IQOS.com 3.3 Flash Deal with details and mechanics below (“Offer”) is available only for persons who are legal age smokers (as of the date of his/her participation in the Offer) who are (a) at least 18 years old who would otherwise continue to smoke or use other nicotine products, and (b) residing in the National Capital Region and selected municipalities, Philippines (“Customer”).

2. The Offer can be availed through IQOS.com. IQOS Stores are operated by ActivAsia Inc. (or "AAI").  IQOS.com is owned by Philip Morris International and its affiliate in the Philippines, PMFTC Inc ("PMFTC"). The online store of IQOS.com is operated by AAI, and all orders are fulfilled by AAI, as an authorized distributor of PMFTC products sold in IQOS Stores and IQOS.com. Deliveries are carried out by AAI or by AAI’s authorized third-party delivery providers. This Offer is being carried out by AAI as an authorized distributor of PMFTC products.  

3. The Offer period for the IQOS Originals ONE kit & HEETS Gift Voucher is on March 3, 2023. The redemption period of the HEETS Gift Voucher is 14 days upon receipt of the voucher through registered mobile number. PMFTC/AAI has the sole discretion to shorten or extend the Offer and/or redemption period if circumstances so warrant..

4. PMFTC/AAI reserves the right to modify, change, or revise the rules and mechanics of the Offer.

5. Customers who use multiple IQOS.com accounts or IQOS accounts to participate in the Offer will be disqualified. PMFTC/AAI reserves the right to disqualify any User if there is any evidence of fraud or irregularities in his/her participation in the Offer.

6. PMFTC/AAI reserves the right to hold, suspend or block a Customer’s IQOS Club, IQOS.com and or IQOS account due to suspicious, fraudulent or illegal activity.

7. PMFTC/AAI reserves the right to cancel, amend, or revoke this Offer without notice in the event of fraudulent activity, cheating, a security breach or any anticipated breach of any applicable law or regulation, an event or disturbance outside of PMFTC/AAI’s control such as acts of God, civil or military events, catastrophes, technical issues/connectivity, pandemic or war. Any changes to the Offer will be announced accordingly.

II. MECHANICS

1. To be eligible for the Offer, the Customer should be a first time purchaser of the device the IQOS Originals ONE device kit or does not have a linked IQOS device in IQOS.com. Customers may choose not to avail of the Offer even if eligible.

2. The Offer is a one-time offer wherein the Customer can avail of the IQOS Originals ONE kit at 30% Off (or just Php 1,183) using Voucher code (33ONEFLASH).

3. Another voucher code for HEETS Gift Voucher at 30% Off (33ONEHEETS) will also be given to the Customer once the Customer completes the purchase transaction of his/her first device being the IQOS Originals ONE device kit and have used the 33ONEFLASH Voucher code (defined below). 

4. As part of this Offer, the Customer will be able to avail of 2 vouchers. First is the 30% Off ONE voucher (33ONEFLASH Voucher) wherein the Customer can avail of the IQOS Originals ONE kit with a 30% Off (33ONEFLASH) Voucher code off on their first device purchase being the IQOS Originals ONE device kit. After their first device transaction being the IQOS Originals ONE kit purchase transaction, the Customer is eligible to receive the 30% Off (33ONEHEETS) HEETS Gift Voucher and Customer will receive this via SMS (sent through their registered mobile number in their IQOS account or in IQOS.com).

During the purchase, a promo code will be applied to the sales transaction to avail of the 33ONEFLASH Voucher code. When transacting in IQOS.com, User should input the 33ONEFLASH Voucher code in the promo section of the checkout page in IQOS.com.

5. The 33ONEFLASH Voucher can only be used once for the purchase of an IQOS Original ONE device kit, while the 33ONEHEETS Voucher can only be used for a one-time purchase of a HEETS ream. The 33ONEFLASH Voucher and 33ONEHEETS Voucher are transacted separately, non-transferrable and cannot be exchanged for cash. The 33ONEFLASH Voucher and 33ONEHEETS Voucher cannot be transferred for payment of an IQOS Originals DUO device, BONDS by IQOS device, BLENDS pack/ream or any IQOS accessories.

6. Only Customers who have opted-in to receiving marketing communications will be able to receive the communications pertaining to the Offer. As part of the Offer, only one (1) Voucher each for the 33ONEFLASH Voucher and 33ONEHEETS Voucher will be sent to the Customer and only one (1) Voucher each for the 33ONEFLASH Voucher and 33ONEHEETS Voucher can be used per Customer. Customer cannot request for their Voucher to be exchanged with a different type of voucher. The Voucher cannot be combined with other special offers, promotions or vouchers.

7. Customers can avail of the IQOS Originals ONE 33ONEFLASH Voucher and the 33ONEHEETS HEETS Gift Voucher only in IQOS.com.

8. The 33ONEHEETS Voucher can be redeemed within fourteen (14) days of receipt throughu their registered mobile, otherwise it is deemed forfeited. PMFTC/AAI has the sole discretion to shorten or extend the redemption period if circumstances so warrant. To redeem the 33ONEHEETS Voucher when transacting in IQOS.com, Customer should input the 33ONEHEETS Voucher code in the promo section of the checkout page in IQOS.com.

9. For transactions via IQOS.com, Customer will be subject to age verification process where he/she will be required to present a valid Government Issued ID during delivery fulfillment.

10. The collectible voucher is non-transferrable and not convertible to cash.

11. To facilitate the purchase and delivery from IQOS.com, Customer must present any of the following valid Government Issued IDs as proof of age: Passport, Alien Certificate of Registration, Driver’s License, Firearms License, NBI Clearance Card, Philhealth ID, Postal ID, PRC ID, SSS ID, TIN ID, Unified Multi-Purpose ID or Voter’s ID.

12. In cases where Customer cannot accept the delivery, an authorized representative who is at least eighteen (18) years old and above can claim on behalf of the Customer provided the following documents are presented to the courier:

a. Valid government issued ID of representative for identity check and age verification
b. Copy of a valid government issued ID of Customer for identity check and age verification
c. Signed authorization letter stating that the Customer is authorizing the representative to receive the item/s and order reference number. 

The courier will not be able to fulfill the delivery if any of the above-required documents are not presented.

13. For deliveries, the courier will communicate and coordinate details, with delivery attempt at a maximum of two (2) times. A third delivery attempt will be available in selected cities that offer same/next day delivery; and can be arranged with an additional delivery fee that will be communicated in advance by AAI/courier, and to be confirmed by the Customer. In the event of failure to receive the delivery for credit card, normal refund process will be followed:

For credit card transactions:
For Credit Cards issued locally: Refund will take up to 10 working days but also subject to issuing bank lead times
For Credit Cards issued abroad: Refund will take up to 45 days, but also subject to issuing bank lead times

14. During the Offer period, for orders using the Voucher that lead to failed transactions due to system limitations or technical issues not due to the fault of the Customer (e.g. order cancellation, failed payment, failed delivery, etc), Customers may request for a one-time replacement Voucher from IQOS Customer Care, subject to the following:

• Review of the failed transaction (e.g. accidental order cancellation, unavailability of the Customer during delivery, etc)
• Customer’s eligibility and compliance with the requirements under these Terms and Conditions.

If still eligible, IQOS Customer Care will send the replacement code for the Voucher to the Customer’s nominated email address as reflected in IQOS.com. It is the responsibility of the Customer to update his/her personal details in their IQOS.com account to ensure timely receipt of the replacement code. PMFTC shall not be liable for any failure of a Customer to redeem or use the code and will not refund the code due to non-receipt by the Customer of the replacement code, if sent to his/her registered email address.

15. PMFTC and/or its authorized representative will verify the identity and age of each Customer.  Customers who fail to pass the verification procedure (e.g. age non-eligibility) shall be informed that they are not eligible to avail of the Offer.

IV. OTHERS

1. The IQOS.com website may be subject to possible technical and system issues. We will provide the necessary notice to the Customers if such is the case.

2. All decisions of PMFTC and/or AAI and its agents in all matters relating to the interpretation and implementation of this mechanics are final, and no objections and/or appeals thereon will be entertained.

3. Customers in the Offer agree and confirm the following:

• that you are a legal-age smoker, 18 years old or above as of the date of his/her participation in the Offer;
• that you have read and understood the terms and conditions detailed herein;
• that you agree to follow the applicable mechanics of the Offer; 
• that you agree to assume all such risks, foreseeable or otherwise, and hereby release and discharge PMFTC and/or AAI, its affiliates and all other persons and entities connected with the Offer from any liability for, or any claims that may arise in respect of, any and all property losses and/or injuries whatsoever that you may sustain, no matter how any such property losses and/or injuries are caused.

5. Devices bought by Customer using IQOS Store vouchers, special offers or through promotional activities are non-refundable.

6. PMFTC will not be liable to the Customers for any taxes, costs, liabilities or expenses that may arise from this Offer.
