Terms and Conditions

 

About Us

1.  The Subscription Terms & Conditions (the “Terms”) are between you and Philip Morris Limited (“we, “our” or “us” as applicable) whose registered office is at 10 Hammersmith Grove, W6 7AP, London, UK .

2. The Terms are listed below. If you have any questions about the service or our products, please call us on 0808 502 2477 or email us at contact.uk@zyn.com.

3. We may amend these Terms from time to time. Unless we provide a delayed effective date, all amendments will be immediately effective on the posting of such updated Terms on our website. If we make significant changes to these Terms, you will be notified by email. Your continued use of subscription services constitutes your consent to be bound by these Terms, as amended from time to time. Please therefore check this page occasionally to ensure that you’re happy with any changes to these Terms.

Eligibility & How to Create a Subscription

4. To create a subscription, you must be an existing nicotine user, aged 18 years or over, with a residential postal address in the UK, have an account profile set up within zyn.com and provide a valid Payment Method (as described at point 24 below). Your ability to set up and use subscription services is entirely at our discretion. We reserve the right to end any subscription and/or decline the creation of any subscription at any time, for any reason and without notice to you.

5. You can only have one subscription active at any given time, but that subscription may include more than one type of smoke-free product (as described at point 9 below) sold on our UK website. The subscription will become immediately effective upon completion of the initial checkout process, and last until such time as the subscription is terminated (see points 30-31 below).

6. Once your subscription has been successfully set up, we will send you a confirmation email outlining that your subscription is now active. This email will also detail the amount you’ll be charged for each recurring order of the same type (“Standard Order”).

7.Only individuals may benefit from Subscription. Companies, partnerships, unincorporated associations and other legal entities are not eligible.  

8. We are not responsible or liable for any errors, omissions or faults caused by you during the creation of any subscription and you warrant that any and all information provided by you is true and accurate.

Subscription Products 

9. Currently, subscriptions are only available for TEREA, LEVIA, VEEV One pods and ZYN (the “Products”). Except for TEREA and LEVIA which can only be ordered in 10 pack bundles, you can order single packs of our Products. For each order placed, you can order a maximum of (i) five bundles of LEVIA or TEREA, or (ii) twenty packs/cans (as applicable) of VEEV One pods or ZYN.

10. We make every commercially reasonable effort to keep the Products available on our website, but we cannot guarantee that any specific Product will always be in stock. If a Product included in your subscription order becomes unavailable—whether due to normal stock fluctuations or circumstances beyond our control—we will be unable to deliver that part of your subscription order and will adjust your subscription charge accordingly. In such cases, we will attempt to contact you to see if you would like to substitute another available Product. Please note that we are not liable for any consequences you may experience as a result, and all future subscription orders will continue as usual.

Subscription Pricing Commitment

11. Subscribers to iqos.com enjoy our best available ‘always-on’ pricing (our “Pricing Commitment”). This means:

- If there is a time-limited promotion on our website offering lower prices on Products included in your subscription, we’ll automatically adjust your subscription cost to reflect these savings for the duration of the offer. Once the promotion ends, your subscription price will return to its usual price.

- As a subscription customer, you’ll also enjoy any additional discounts available through multi-buy offers or multi-buy pricing on our Products. When you add eligible multi-buy items to your subscription, these additional savings will be automatically applied.

- If you are an IQOS Club member, you’ll benefit from tier-linked member only pricing on eligible Products.

Subscription modifications

12. You may customize your Standard Order and increase it up to the maximum quantities established in these Terms. You may also decrease your Standard Order subject to the minimum Subscription order.  

13. You may customise your Standard Order to change the flavour(s) or product(s) selected to any of the flavours or products available in the UK.  

14. You may customise your Standard Order to change your delivery address provided that your new delivery address is also in the UK. 

15. You may change the delivery frequency for your Standard Order. You can set the frequency for your Standard Order to: every 2 weeks (bi-weekly); every 4 weeks (monthly); or every 8 weeks (bi-monthly). 

16. Each customisation request will automatically update your Standard Order to reflect the changes you have requested for all future deliveries.  

17. If any of these changes are requested after your Cut-Off date displayed on your Subscription account dashboard, these changes will only be applicable for your next order.  

18. You may make changes in your delivery date at any time up to the Cut-Off Date by bringing the date forward by up to one week or delaying it by up to one week. Any subsequent deliveries will be adjusted and delivered according to this new schedule for your Standard Order.  

19. You may change your future delivery dates by selecting a new date range each month on your Subscription account dashboard. If you change the delivery date after the Cut-Off Date for your next Subscription, your change will take effect for your next delivery.  

20. At any time ahead of the cut-off date, you may skip your next Subscription order. Simply log-in to your account, navigate to ‘My Subscriptions’ and select to ‘Skip next delivery’. We allow for 3 consecutive ‘skips’ in a row before your subscription is automatically cancelled. 

21. If your skip request is made after the Cut-Off Date for your next Subscription, your change will take effect on the following scheduled delivery.  

22. We will cancel your Subscription in the event we are unable to access your delivery address or if we are informed you are no longer at the delivery address. We will contact you to request that you update your address. 

23. If your payment is not made due to your credit card having expired or if we are having any problems processing your payment then we will re-attempt payment collection once a day for three consecutive days. We will contact you to ask you to update your payment method. However, if the third payment attempt is unsuccessful then we will cancel your subscription order. 

Billing

24. We only accept payment by Visa or Mastercard ("Payment Method”). We reserve the right to update and/or otherwise amend our accepted Payment Methods from time to time.

25. By signing up for a subscription, you grant us permission to charge your selected Payment Method for your initial order, as well as for each subsequent order, based on the prevailing Product prices listed on our website at the time of processing. This ongoing payment authorization (“Continuing Payment Authority”) ensures your subscription orders are fulfilled without interruption.

26. Once you set up your subscription the payment for your initial order will be processed immediately. Unless we tell you otherwise, future charges for your subscription will be collected on the day your order is prepared for dispatch, and this will continue until you or we cancel the subscription according to these Terms. Subscription orders will be prepared for dispatch three business days before your scheduled delivery date (“Cut-off date”).

27. Should we be unable to process payment for your orders, we will notify you via email. In such cases, your subscription will be suspended, and no orders will be processed or dispatched until the payment issue is resolved. If the problem is not addressed within a reasonable time after our notification, we reserve the right to immediately cancel your subscription without further notice.

Delivery

28. All subscribers benefit from free delivery. Please note that all additional terms and conditions related to delivery, as outlined in Section D “Delivery & Postage” of our standard terms and conditions available on zyn.com remain applicable.

Return of Products

29. If you need to return any Product(s), please refer to our standard Terms and Conditions for detailed instructions, or contact Customer Care for further assistance.

Subscription cancellation and termination

30. You may cancel your subscription at any time by logging into your account and selecting the “Cancel subscription” option, or by contacting Customer Care, provided you comply with the requirements set out above.

31.  We will terminate your subscription if:

- you skip more than three consecutive deliveries; or

- you breach these Terms; or

- we are unable to access your requested delivery address; or

- we are informed that you’re no longer resident at the delivery address registered to your account; or

- after three consecutive days we are unable to collect payment for a subscription order.

32. If your subscription is cancelled or terminated while an order is already in the process of delivery, that order will still be delivered and you will be responsible for payment. After delivery, neither party will have any further obligation to the other under these Terms.

Data Protection

33. Philip Morris will receive, store, and otherwise process your personal information in connection with your Subscription and administering it. General

34. You agree:

- to keep all information relating to your Subscription (including your account password) safe and secure;

- you are responsible for all purchases made on your subscription account;

- you are responsible for all actions and changes to your subscription account in the logged in pages of your subscription dashboard;

- you will notify us immediately if you suspect or know that anyone has gained unauthorized access to your subscription account;

- to promptly inform us (and provide accurate up to date information) when you change your address and/or payment details.

35. We reserve the right (in our absolute discretion) to take any action we believe to be appropriate if we consider that any account holder is abusing our subscription services. 

36. If any provision of these Terms is found by any court or administrative body of competent jurisdiction to be invalid, unenforceable or illegal, the other provisions shall remain in force.

37. A failure by us to exercise, or delay in exercising, a right, power or remedy provided by these Terms or by law shall not constitute a waiver of that, or any other, right, power or remedy and shall not, and nor shall any single or partial exercise of any such right, power or remedy, preclude the further exercise of that, or any other, right, power or remedy.

38. We do not accept any responsibility nor any liability (unless such liability cannot be lawfully excluded) for your use of the subscription (including but not limited to use of your subscription account) where such use is undertaken in a manner which is inconsistent with these Terms, our standard Terms and Conditions Terms and/or the Website User terms.

39. We do not accept responsibility and will not be liable (unless such liability cannot be lawfully excluded) for any losses, damages, expenses or other liabilities arising from or in connection with (whether direct or indirect) any technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind or for any errors solely due to the actions by you relating to a Subscription or for any circumstances beyond our control, including but not limited to, accident, fire, flood, acts of God, strike, lock-out or other industrial disputes (whether or not involving our employees) or legislative or administrative interference.

40. These Terms will be governed by English law and you hereby agree to submit to the exclusive jurisdiction of the courts of England and Wales.
